<p>Arbory residential home is a large care home, registered to provide accommodation and personal care for up to 64 residents who require nursing or personal care. It is owned by ABC Shelf Ltd. <br /> <br /> CQC inspectors visited the home in December 2010 as part of our routine schedule of planned reviews, and as a result of concerns raised to us by Social Services. We reviewed all the information we hold about this provider, observed how people were being cared for, talked with people who use services, talked with staff, checked the provider's records, and looked at records of people who use services. <br /> <br /> <a href="http://www.cqc.org.uk/newsandevents/newsstories.cfm?FaArea1=customwidgets.content_view_1&amp;cit_id=37374">The CQC report</a>, which is published today, has concerns about 14 essential standards with major concerns in five areas: <br /> <br /> - Care and welfare of people: Residents were at risk of not always being given safe and appropriate care. Their care needs were not identified correctly and there was a lack of management control to ensure that staff carried out their care responsibilities effectively. <br /> <br /> - Nutrition: Residents were not always supported to have enough food and drink. Their nutritional needs were not always assessed and monitored effectively, which put them at risk of harm to their health. <br /> <br /> - Cleanliness and hygiene Residents were put at risk because the home did not provide and maintain a clean and appropriate environment and did not have systems to manage and monitor the prevention and control of infection. <br /> <br /> - Management of medicines: There was unsafe management of medicines. There was a lack of effective monitoring, dispensing and recording that meant people did not always receive the correct medicines as prescribed. <br /> <br /> - Staff training and supervision: People did not have their needs met by competent staff. Staff had not been trained and supervised effectively to improve their practices. <br /> <br /> Arbory Residential Home has submitted an action plan to CQC, outlining how it will address these remaining concerns in order to meet the standards. Inspectors will return to the care home unannounced to check whether the improvements have been made and to decide whether to initiate formal enforcement action. <br /> <br /> CQC Regional Director for the South East, Roxy Boyce, said: "The care at Arbory Residential Home has fallen far short of the standards people have a right to expect. <br /> <br /> "The law says these are the standards that everyone should be able to expect when they receive care. Providers have a duty to ensure they are compliant " or face the consequences. <br /> <br /> "Our inspectors will return to Arbory Residential Home very soon, and if we find that the home is not making progress we won't hesitate to take enforcement action on behalf of the people who live there." <br /> <br /> By law, providers of care services have a legal responsibility to make sure they are meeting the essential standards of quality and safety. We will continue to monitor progress and we will check to make sure that the improvements have been made. <br /> <br /> Under the Health and Social Care Act 2008, the Care Quality Commission has a number of new enforcement powers that enable it to act swiftly when services are failing people. These include issuing warning notices, restricting the services that a provider can offer or the way it is provided; or, in the most serious cases, suspending or cancelling a service. <p>All practices will be expected to register with the watchdog from April 2012. Unless the fee is paid directly by the Treasury, the GPC plans to submit evidence to the Doctors' and Dentists' Review Body calling for funding to cover it.</p>
<p>Dentists were obliged to register from April this year, and pay a &pound;1,000 annual fee.</p>
<p>The rate for GPs is expected to be similar.</p>
<p>Although dentists pay the fee directly, the GPC has argued that dentists can raise additional income in ways that GPs cannot. GPC chairman Dr Laurence Buckman described the registration cost as 'a tax on doctors'.</p>
<p>The CQC system, which requires GPs to meet essential standards of quality and safety, was recently trialled by NHS Derbyshire across 21 practices.</p>
<p>Derbyshire LMC secretary Dr John Grenville said a key problem faced by the pilot practices was limited time to prepare. 'When it becomes real, practices will be given a fortnight,' he said.</p>
<p>He urged practices to prepare for registration in advance and ensure that their practice managers were not away.</p>
<p>Practices should be aware that they 'don't have to present all evidence at time of registration', Dr Grenville said.</p>
<p>Once practices have made a 'self-declaration' the CQC may look into and discuss any plans.</p>
<p>Practices should have a written protocol to prove they are doing what they have claimed, he said.</p>
<p>Dr Grenville predicted GPs would have to pay a registration fee similar to the price for dentists, around &pound;1,000.</p>
<p>Practices operating from more than one site can avoid additional registration fees by appointing a 'single officer' with legal responsibility for their registration, he said.</p>
<p>A CQC spokesman said that it would be holding a consultation over the summer to decide on how registration fees should be paid. The GPC plans to issue a CQC registration toolkit in late May.</p>

<p style="margin: 10px 0px;">Practices will need to meet 21 sets of regulatory requirements, laid out in a 300-page guidance document, and those with multiple branch surgeries face having to fill in forms and pay registration fees separately for each location.</p>

<p style="margin: 10px 0px;">News of the looming deadline came as the British Dental Association, whose members were registered last week, a year ahead of GPs, warned the process had been &lsquo;shambolic&rsquo; and &lsquo;lurched from one crisis to another&rsquo;. It said it had &lsquo;serious concerns over what our medical colleagues could be subjected to&rsquo;.</p>
<p style="margin: 10px 0px;">Practices will start submitting evidence online in October this year, with a December deadline to demonstrate compliance in areas as diverse as equipment safety, record keeping and management structure, in order to be registered with the<span class="Apple-converted-space">&nbsp;</span><a style="color: #333333;" href="http://www.cqc.org.uk/" target="_BLANK">CQC</a><span class="Apple-converted-space">&nbsp;</span>from <strong>1 April, 2012.</strong></p>
<p style="margin: 10px 0px;">GPs will be required to adhere to CQC outcome standards already applied in other areas of health and social care, including respecting and involving people who use services, co-operating with other providers, safeguarding people who use services from abuse, medicines management and safety of premises (see box).</p>
<p style="margin: 10px 0px;">The CQC is still to consult on the thorny issue of GP registration fees &ndash; reduced from &pound;1,500 to &pound;800 per surgery for dentists following widespread revolt &ndash; but told Pulse it was likely to continue the policy it has adopted with hospitals and care homes of asking providers to register per location.</p>
<p style="margin: 10px 0px;">A spokesperson said: &lsquo;We register care homes as individual instances of care. Even if a provider has two or three, it&rsquo;s the locations that are registered. I would be very surprised if we broke from the model we&rsquo;ve done for everyone else.&rsquo;</p>
<p style="margin: 10px 0px;">But the spokesperson insisted the regulator would be flexible when setting fees, adding: &lsquo;We will listen to the industry and we are flexible.&rsquo;</p>

<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">They found that as well as there being no evidence of practices to ensure patients' consent is valid, they were also concerned about the safeguarding of patients and staffing cover.</p>
<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">They produced a report on March 28, and asked the trust to complete a report within 28 days, setting out the action they will take to meet the essential standards.</p>
<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">If those standards were then not met, the home could be fined or closed down, but the CQC believes that Beatrice House is dealing with them appropriately.</p>
<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">Dr James Warner, clinical director for older people services at the trust, said: "Three Beatrice Place has a motivated and caring staff group who are committed to improving and developing the service.</p>
<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">"This report highlighted areas for concern and immediate action has been taken to improve the quality of care against these recommendations.</p>
<p style="margin: 0px 0px 15px; padding: 0px; line-height: 16px;">"We have a detailed action plan in place that will address all the points raised and we will continue to monitor how the service is performing in relation to the CQC's essential standards."</p>

<p style="margin: 10px 0px;">Consortia will use local league tables to monitor practice performance in areas such as referrals and take on whole chunks of contract management, including clinical governance and clinical audit to ensure &lsquo;continuous improvement&rsquo;. They will have a duty to &lsquo;identify poor performance&rsquo; and call in the NHS Commissioning Board, the<span class="Apple-converted-space">&nbsp;</span><a style="color: #333333;" href="http://www.gmc-uk.org/" target="_BLANK">GMC</a><span class="Apple-converted-space">&nbsp;</span>or the<span class="Apple-converted-space">&nbsp;</span><a style="color: #333333;" href="http://www.cqc.org.uk/" target="_BLANK">Care Quality Commission</a><span class="Apple-converted-space">&nbsp;</span>to investigate or order remedial action.</p>
<p style="margin: 10px 0px;">Consortia boards will also be put in charge of tens of millions of pounds of enhanced services funding for practices, as for the first time some GPs take control over their colleagues&rsquo; income.</p>
<p style="margin: 10px 0px;">GPC negotiator Beth McCarron-Nash said: 'This is the first time someone else will have control over your pay. It will be other GPs but I don't think that will make it easier. In some ways it may make it harder.&rsquo;</p>

<p style="margin: 10px 0px;">'The trouble in the past has been that despite the plans for services coming out of hospital there has been no extra funding for the services in primary care. This gives consortia the power to direct that money,&rsquo; he said.</p>
<p style="margin: 10px 0px;">But he admitted the move could effectively force consortia to divert the funding to private providers.</p>
<p style="margin: 10px 0px;">'The Government's has any willing provider as a key part of its policy and this could lead to private firms being awarded enhanced services because they are offering the cheapest price. What you could end up with is a very fragmented service.'</p>
<p style="margin: 10px 0px;">Dr Kambiz Boomla, chair of City and Hackney LMC, said: &lsquo;The problem with devolving performance management to consortia is that when patients demonstrate against the cuts, they are going to be demonstrating outside GP practices. It takes responsibility away from the Government who were happy to take the credit in the period of growth.&rsquo;</p>

<p>It added it was proud of significant improvements to delays  and providing high quality clinical care to patients with emergency  needs.</p>
<p>The CQC published the report after raising concerns in April.</p>
<p><span class="cross-head">'Inspectors to return'</span></p>
<p>The watchdog, which grades health services across England,  said the ambulance service must take action to ensure "all its staff  receive an annual appraisal where their training needs can be properly  assessed".</p>
<p>"At CQC's request, the trust has now produced plans to show how it intends to achieve compliance.</p>
<p>"Inspectors will return unannounced to check whether the  improvements have been made and to decide whether to initiate formal  enforcement action."</p>
<p>Last year, the CQC rated South Central Ambulance Service as "weak" for failing to meet its target response and treatment times.</p>
<p>It was among the three worst ambulance trusts in England after slipping from "good" in 2007/8.</p>
<p>The ambulance trust provides 999 cover for Hampshire, Berkshire, Oxfordshire and Buckinghamshire.</p>
